Terms of Service

Satisfaction Guarantee

If during your first 30 days of service you are unhappy with the services you receive from FullMatter.com for any reason, you may request in writing via email or by support ticket form (as mentioned below) that your services be discontinued and your reason for cancelling, at which time you will receive a full refund. We are the sole arbiter as to if your reason is valid and if all possible steps were taken on our side and on yours to correct the situation causing the interest to cancel. Note that all domain registrations are non-refundable.

New Accounts

All new web hosting accounts purchased on our order page are set up shortly thereafter by our account administrators. You will receive a welcome email including login details after your purchase. This process may sometimes be delayed due to complications with various mail servers or connection problems between your ISP and FullMatter, so if you don't see the welcome email in your Inbox, kindly check your Spambox/Junk Folder as well.

Domain Names & Domain Transfers

In order for your domain name to point to the FullMatter server on which your new account is located, you must change your DNS (Domain Name Servers) at your registrar. These DNS are located in your welcome email and they are defined in a pair (ns1.fullmatter.com and ns2.fullmatter.com). If you choose to perform a domain transfer, which would transfer your domain registration away from your original registrar to FullMatter.com, payment will go toward one year of registration with FullMatter, added onto your current registration period with the previous registrar. By registering your domain with FullMatter.com you agree to the Registrant Rights & Responsibilities as outlined by ICANN here. Keep in mind that domain registration is irreversible, and the price will vary depending on the extension of the domain name.

Domain Names Renwals

For domain name renewals, client takes full responsibility for renewing their domain names prior to expiration. FullMatter is not responsible for a client's expired domain name. If you have any questions at all about DNS changes or domain names in general, you are welcome to contact us via email or by support ticket form at our helpdesk.

Modification

FullMatter.com reserves the right to add, delete or modify any provision of this policy at any time without notice. You agree to be bound by any changes FullMatter may reasonably make to this agreement when such changes are made. If you have purchased services or software from FullMatter, the term of this agreement shall continue as long as you take advantage of and use the services or software that we provide.

Content

FullMatter.com believes in freedom of speech and works to keep it that way. We prefer that you self-govern your content, as you are responsible of what your website publically provides; and if other users have access to your account, you are responsible for their actions. FullMatter will not tolerate any content (written, visual, or implied) in the following areas and is grounds for immediate suspension of service: racism or prejudice due to color, creed, or belief; any violent/malicious/obscene content; and any type of hate site including terrorist related websites.

If we receive notice of any questionable content or hate site hosted within our network, we will address the concerns immediately and directly with you to seek an amiable resolution. Should the content be deemed against policy, client is required to remove the content within 24 hours of FullMatter's notification or will face account suspension and/or termination. In most cases, FullMatter will help create a zip file of the site/account for the customer. If any person contacts us about content they have found on a FullMatter server that copyrights their own material or that they wish to be removed, we require a proper DMCA notice to begin investigation.

Liabilities

FullMatter.com makes no endorsement, claims, or promises regarding the services offered by our customers and will not be held liable for any disputes or claims against said customers. In no event shall FullMatter.com be liable for any direct, indirect, incidental, consequential, special and exemplary damages, or any damages whatsoever, arising from the use or performance of a customer web site, or from any information, services or products provided through a customer web site or from FullMatter's services. If there is questionable content on any server in our network, we will not take any action against any material or action until the website is brought to our attention by contacting us.

Hosting Package Modifications

We are always evolving to stay competitive in the market, so if modifications are made to our plans in the future, such as specifications or price, the change will not automatically take effect on your plan. It is the sole responsibility of the client to request any updates or modifications to a plan.

Payments & Agreement To Pay

As consideration for the software or services purchased by you and provided to you by FullMatter, you agree to pay FullMatter at the time you order. All fees are due immediately and are non-refundable after our satisfaction guarantee period or otherwise expressly noted, even if your services are suspended, terminated, or transferred prior to the end of the services term. You may make payment by providing either a valid credit card, Stripe payment, and/or PayPal email address. Services are all billed on an automatic basis on the service creation day on a regular schedule, most often annually. If a payment method is saved on file with FullMatter.com, FullMatter will try to automatically renew your services when they come up for renewal at its current rates.

If for any reason, FullMatter is unable to charge your payment method for the full amount owed, or if FullMatter is charged a penalty for any fee it previously charged to your payment method (such as a charge back dispute), you agree that FullMatter may peruse all available remedies in order to obtain payment. You agree that among the remedies FullMatter may peruse in order to effect payment, shall include but will not be limited to, immediate cancellation without notice to you of any domain names or services registered or renewed on your behalf. You agree that you are solely liable for arranging that your services are renewed, and that FullMatter shall not be liable to you or any third party if it is unable to charge your payment method in order to renew your services. You also agree that you are liable for all services that have been rendered on your behalf until a termination of service has been officially received by the account holder for services.

Late Payments

If at any time, your hosting services become past due, you will receive a notification via email to the most recently updated email address on file with instructions on rectifying the situation. Please note that FullMatter.com holds the right to deny all services to clients with past due balances. This may or may not affect clients with multiple accounts, as a past due balance, regardless of which individual package it applied to, will cause interruption in all services provided by FullMatter.com.

Shared hosting accounts 7 days past due will be assessed a late fee of $10.00 to re-activate service. We only accept credit cards, debit cards, Stripe, or PaypPal for payment of services. We do not record any credit card details. All clients will need to login and pay their invoices and/or manage their automatic recurring payment subscription.

In the event that your charge is denied and we are unable to contact you, then the aforementioned fees to enable your account shall apply. Monthly installments will incur for the entire duration services are rendered and you remain subscribed to until you submit proper cancellation of the account. If an account holder submits a bank assisted dispute for services rendered, their hosting account will be de-activated within 48 hours if the payment issue has not been recovered. A $50.00 charge back fee will be added to the amount disputed by the customer. Any debt not paid 45 days after the due date will be forwarded to an outside collections agency for proper collection. At that time, the account holder will incur a $50.00 USD collection fee added to the balance previously due.

Please note that FullMatter.com holds the right to deny access to and/or de-activate accounts hosted on our servers with past due balances. Please address any questions regarding payments to our billing department by opening a ticket at our helpdesk at http://www.FullMatter.com/submitticket.php.

Overage Charges

Our service plans are designed to accommodate the majority of usage scenarios given the needs of our customers. However, your usage may vary and require additional allocations, specifically in the areas of storage and traffic. We will never charge your card automatically if your account requires more resources. You must keep your email address updated within your cPanel, so that you may receive an email when your account reaches certain limits determined by our system (ie. bandwidth exceedment warning at 80%), at which time you may contact us to purchase a higher transfer quota for your account. If you do not contact us, the system will suspend your site if your allotments exceed.

Cancellations

If you wish to cancel your services, you must submit a cancellation ticket five (5) business days prior to your renewal date. If your notice of cancellation is not received within this time frame, you will be liable for payment of the proceeding month/year and hereby agree to complete payment as invoiced accordingly.

If you cancel your account and your payments still continue to recur for any reason such as 1) by fault of the credit card processor 2) by fault of FullMatter staff 3) by fault of any other payment collection company, we are to be held free of liability for any overdraft fees that are issued by your financial institution.

Refunds & Account Termination

If, for any reason, FullMatter fails to deliver said services to you, a prorated refund will be issued. No refunds will be issued if abuse of our stated policies forces FullMatter to suspend or terminate your services prematurely. In the event you request account cancellation, once your service has been cancelled your account will be suspended from use. It will then be deleted within 15 days. Cancellations of accounts pre-paid will not receive a refund for the remainder of the billing period. All add-on service payments are non-refundable as they are included only during the life of the hosting plan. If for any other reason your account becomes suspended and remains suspended it will be deleted after a 15-day period.

Bandwidth Usage Policy

All dedicated and colocated servers are given access to bandwidth graphs which are updated in five minute intervals. These graphs are located in the client area (see "Usage Statistics"). All bandwidth billing is exclusively calculated based on the graphs provided in client area.

Resource Abuse Policy

Accounts on a shared server must share resources with other users so we must limit how much of the CPU and memory that can be used by any one account. Any website on our shared servers that uses a high amount of server resources (CPU, memory usage, and network resources) will be given an option to pay for an upgraded service or plan.

At any given time a server is unstable and an account is found to be the cause, we reserve the right to suspend the account to keep the server online and operating normally. If the usage is an increasing trend, we recommend the user invest in a dedicated server so the website can grow at a normal rate without restriction.

Suspensions

In the event your website has been suspended for resource abuse (abuse that cannot be resolved by removing/changing a script, etc.) and you do not wish to upgrade to a dedicated server to accommodate your site needs, we will only release the suspension within 24-48 hours. This is to ensure the CPU intensive site slows down in traffic to avoid further damage and problems. A backup will then be provided of your files or you will be allowed FTP/cPanel access for a certain time period. Any questions about our abuse policy may be answered by opening a ticket at our helpdesk at http://www.fullmatter.com/submitticket.php.

Inodes

Accounts on any shared hosting account may not have an excessive number of inodes. Any account found to have over 100,000 inodes may be removed from our backup system to prevent overload. Any account seen to be exceeding 250,000 inodes may risk suspension. A warning will be sent and if no action is taken to resolve the issue, the account may be suspended. Every file on the account is counted as 1 inode. This includes mail as well as webpage content.

Cron

We allow customers to set up cron jobs to perform routine functions automatically. To prevent abuse of the system, clients are not permitted to schedule cron jobs which take more then half the time to complete before the next scheduled iteration, nor more frequently then 10 minutes. Any automated processes that excessively consume resources and impact server stability may be disabled at our discretion by our technicians.

cPanel Transfers

FullMatter.com provides free cPanel account transfers for all new accounts (less than 30 days from sign-up date). Transfer requests submitted after this 30-day period are subject to transfer fees based on source account size. Please contact our helpdesk for more information. If it's from a server outside of FullMatter's data center, we will make our best effort to transfer your data and cannot be held responsible for the integrity of your transferred data. If we are unable to complete the transfer, we will let you know so that you can handle the transfer yourself.

This privacy policy explains how FullMatter.com (together with its subsidiaries, affiliates, FullMatter), collects, uses, maintains, and discloses information collected from our customers, visitors to our website, individuals who contact us, and visitors to our customers websites ("Users"). FullMatter strives to provide a safe, reliable, and enriched browsing and service experience to clients and the global community. In order to fulfill this goal we sometimes collect information during your visit to our website. We do not offer for sale, share, or lease any information given to us, except as disclosed in this privacy policy ("Privacy Policy"). Our Privacy Policy applies to prospective, current, and former customers and users.

The terms of this Privacy Policy are in conjunction to the other legal policies and terms on this page including our Terms of Service (TOS) and Acceptable Use Policy (AUP), collectively known as FullMatter Legal Policies, and any specialized contracts that may have been agreed upon. We offer products and services that are provided by third parties ("Third Party Products"). These Third Party Products (including WordPress and PayPal) may collect and use information in ways that differ from those stated in this Privacy Policy. FullMatter does not take responsibility for how these Third Party Products utilize your information and we instruct you to visit the respective service provider's website for more information.

When you visit our website, FullMatter may collect information to administer the site and analyze its usage, such as:

Personal Information

On some pages of our website users can register to purchase products or services, receive personalized content, and participate in surveys or forums. If you purchasing products or services from FullMatter, we will request financial information such as credit card or bank account information. Any financial information we collect is used only to bill you for the products and services you purchased. If you purchase by credit card, this information may be forwarded to your credit card provider. For other types of registrations or service inquiries, we will ask your name, address, e-mail address, or telephone number. We may then contact you with information about FullMatter products and services.

Support & Access

As a service subscriber you may be asked to disclose personal information to FullMatter so that we can provide technical support to you. We may collect personal information for account verifications in order to provide technical support and troubleshooting services via our helpdesk. If you choose to contact us via email, livechat, or helpdesk, we may retain a copy of the communication with your email address, account information, and our responses. FullMatter makes reasonable effort to make sure all collected data is reliable, up to date, accurate and complete.

Additional Information

To preserve the integrity of our website and network, FullMatter may use software programs to monitor network traffic or to identify unauthorized attempts to damage or hack our service. These software programs may also collect information regarding your usage of our services, website, and network.

How We Use Your Information

Customer Record and Inquiries

FullMatter uses the information we collect to notify you about your account and to notify you about changes of the terms and conditions governing use of our websites, products and services. We may also use the information we collect to notify you about other products and services we think you will find valuable and about special offers. You may notify us of your desire not to receive notifications relating to new products and services and specials offers by opting-out as provided for below.

Our employees, contractors, or agents will at times require access to your personal information. FullMatter permits access to this information only for business purposes such as administration and support for our products and services.

Information Released

FullMatter may provide aggregate information about our customers, our websites traffic patterns, and related website usage information to our affiliates and reputable third parties, this information will never include personal identifying data. We take all available measures to select affiliates and service providers that are ethical and provide similar privacy protection to their customers and the community. We do not make any representations about the practices and policies about these companies.

Compliance with Laws and Law Enforcement

We cooperate with government and law enforcement officials to enforce and comply with the law. We will disclose any information about Users upon valid request by government or law officials as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including without limitation subpoenas), to protect your property and rights, or the property and rights of a third party, to protect the safety of the public or any person, or stop activity we consider illegal or unethical.

Contacting You Directly

FullMatter may contact you directly through the email address or other information provided upon account signup. FullMatter will contact you to respond to your questions, to provide the services you request, to manage your account, and/or to inform you of any service announcements. If you require an account contact change, please submit a ticket to our Support department via http://www.FullMatter.com/submitticket.php

Opt-out

If you do not want to receive promotional materials or surveys from FullMatter, you may opt out at any time. You may opt-out by clicking the "Unsubscribe" link in Surveys, or simply sending a message to Ted(at)FullMatter.com with the subject "I do not wish to receive special communication from FullMatter". Once this message is received, all reasonable measures will be taken to remove your account from future non-pertinent account mailings.

Third Party Service Providers

We will only share your information when necessary for the third party to provide the requested service. We may provide information about you to third parties to provide various services on our behalf such as processing credit card payments and hosting service add-ons. These service partners are prohibited from sharing or storing your personal identifiable information for any purposes unrelated to providing the said service.

How We Protect Your Information

FullMatter uses technical security measures to prevent the loss, misuse, alternation or unauthorized disclosure of information under our control. FullMatter uses security measures including and not limited to: firewalls, non public facing systems, complex passwords, anti-virus, and mitigation and detection software. When we ask customers or users to provide financial information (such as a credit card number) that data is protected using Secure Sockets Layer (SSL) technology. However, keep in mind that electronic communication sent to us such as email, chat, or instant messaging may not be secure unless we advise you in advance that security measures will be in place prior to your transmitting the information. For that reason, we ask that you do not send confidential information such as financial information, social security numbers, or passwords to us through unsecured electronic communication.

Access to Your Personal Information & Correction

If you wish to access and/or update your personal information stored on our service, you may either login to our client administration area and change your information, or contact us via http://www.FullMatter.com/submitticket.php.

Transfer to Third Parties

If you wish to transfer your account to a third party (ex: new webmaster, new company owner), you must make this request via email or submitting a helpdesk ticket at http://www.FullMatter.com/submitticket.php. After your request is received we will provide a transfer of ownership form and we will complete an account standing and history audit. Once you have returned the account ownership request form your account and request will be verified by our team. Once the account ownership change is verified and processed, the new account owner will be protected by this Privacy Policy.

Transfer of Data Abroad

If you are visiting the FullMatter website from a country other than the countries in which our networks are located, the various communications will necessarily result in the transfer of information across international boundaries. By visiting our website and communicating with us you consent to the processing and transfer of your data as set by this Privacy Policy.

COPPA

In accordance with the Childrens Online Privacy Protection Act (COPPA), FullMatter does not knowingly collect or solicit any personal information from children under the age of thirteen (13).

Updates & Modifications to the Privacy Policy

FullMatter uses a self-assessment approach to ensure compliance with this Privacy Policy and regularly verifies that the Privacy Policy is accurate, displayed, accessible, and within the guidelines of the Safe Harbor Privacy Principles. FullMatter hereby reserves the right to amend, alter, modify, replace or suspend this Privacy Policy, from time to time, in its sole discretion. All changes to this Privacy Policy will be effective when posted on the FullMatter website.

Acceptable Use Policy

The terms and conditions which follow are necessary to ensure that we may continue to provide the best possible service to all of our customers whilst at the same time satisfying our legal and ethical responsibilities. Failure to follow any term or condition will be grounds for immediate account deactivation without notice. FullMatter will be the sole arbiter as to what constitutes a violation of any of these provisions. Activity which results in the suspension or deactivation of an account will result in a forfeiture of all fees paid. Complaints made regarding abuses of an account will be investigated and if found guilty will be grounds for immediate suspension. Illegal Usage

FullMatter servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material, trademark, trade secret or other intellectual property right used without proper authorization, prescription drug sales, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws or the laws of the state of Florida. Examples of non-acceptable content or links: Pirated software, Hackers programs or archives, "Warez" sites, MP3, and IRC bots. The subscriber to FullMatter service agrees to indemnify and hold harmless FullMatter from any claims resulting from the use of the service that damages the subscriber or any other party. No online pharmacies are allowed on our network. Sites related to High Yield Investment Programs, Ponzi schemes or pyramid schemes are prohibited. FullMatter will be the sole arbiter as to what constitutes a violation of this provision.

Security

Violations of system or network security are prohibited, and may result in criminal and civil liability. Examples include, but are not limited to the following: Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks. Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

Server Resource

Any website that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given an option of either paying extra for a service upgrade plan or reducing the resource used to an acceptable level. FullMatter shall be the sole arbiter of what is considered to be a high server usage level.

Background Running Programs

FullMatter does not allow background Daemons such as IRC bots; and any other program that interferes with normal server operation.

IRC

FullMatter does not allow IRC server, IRC bots, or IRC shells to be operated on our network.

Banned Scripts

We do not allow proxy servers or scripts, torrent trackers or torrent clients to be run from our shared hosting servers. Also, FullMatter doesn't register/install any 3rd party DLLs/EXEs or software on our shared hosting servers.

Client Responsibility

The client is responsible for all activity originating from the account unless proven to be a victim of outside hacking or address forgery. The client is responsible for securing their username/password. The client assumes responsibility for all material on their site that may be put on by a third party (such as the usage of Free For All links pages). The client agrees that he or she has the necessary knowledge to create and maintain their web space. Client agrees that it is not the responsibility of FullMatter to provide this knowledge or support outside matter specific to FullMatter servers.

UCE-M (Unsolicited Commerce Email - Material) - SPAM

Uploading, posting, emailing, transmitting or otherwise making available any unsolicited or unauthorized advertising, or promotional materials where examples of these include but are not limited to "junk mail", "instant messaging", "chain letters", "pyramid schemes", or any other form of unauthorized solicitation from or through a FullMatter server or using an email address or system that is maintained by FullMatter is strictly prohibited. FullMatter will be the sole arbiter as to what constitutes a violation of this provision. If you engage in any of the foregoing activities using the service of another ISP or IPP, but channeling activities through a FullMatter server as a mail drop for responses, you are in violation. Violators will be assessed a minimum of $200.00 fine and will face an immediate suspension and/or termination.

Server Abuse

Any attempts to undermine or cause harm to a FullMatter server or customer of FullMatter is strictly prohibited. Any sub-networks of FullMatter and dedicated servers must adhere to the above policies. The failure to meet or follow any of the above guidelines are grounds for account deactivation. We reserve the right to remove any account without prior notice. User agrees to only use shared hosting services for its intended applications. Misuses include scientific/grid/distributed computing, data warehouse/backup storage, or bandwidth sinks. FullMatter.com will be the sole arbiter to what is considered a misuse of service. User agrees to ask FullMatter.com in the event they are unsure of their application's fitness for our shared hosting services.

Software Distribution

FullMatter.com's shared Web Hosting accounts are not to be used for the purposes of distributing software and multimedia products. If you wish to distribute software and/or multimedia files, please contact Ted(at)FullMatter.com for special arrangement.

Multimedia Files

Multimedia files are defined as any graphics, audio, and video files. FullMatter.com Web Hosting accounts are not to be used for the purposes of distributing and storing unusual amount of multimedia files. Any Web site whose disk space usage for storing the multimedia files exceed 70% of its total usage, either in terms of total size or number of files, will be deemed to be using unusual amount of multimedia files.

Domain Names

FullMatter will take necessary steps to register domain names on behalf of the client when requested. However, clients are responsible for renewing their domain names. FullMatter does not take responsibility for failing to renew domain names. If your domain name was registered via our company, you must check and take appropriate actions to renew a domain that is about to expire.

Actions Taken by FullMatter

The failure by a customer to meet or follow any of the above policies/terms is grounds for account deactivation. FullMatter will be the sole arbiter as to what constitutes a violation of the AUP. FullMatter reserves the right to remove any account without prior notice. When FullMatter becomes aware of an alleged violation of its AUP, FullMatter will initiate an investigation. During the investigation, FullMatter may restrict a customer's access in order to prevent further potentially unauthorized activity. Depending on the severity of the violation, FullMatter may, at its sole discretion, restrict, suspend, or terminate a customer's web hosting account and/or pursue other civil remedies. If such violation is a criminal offense, FullMatter will notify the appropriate law enforcement authorities of such violation. FullMatter does not issue credits for outages incurred through service disablement resulting from AUP violations.
FullMatter customers agree to indemnify and hold harmless FullMatter from any claims resulting from the use of our services that damages them or any other party. The FullMatter service is provided on an as is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. FullMatter expressly disclaims any representation or warranty that the FullMatter service will be error-free, secure or uninterrupted. No oral advice or written information given by FullMatter, its employees, licensors or the like, will create a warranty; nor may you rely on any such information or advice. FullMatter and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.

Modification

FullMatter reserves the right to add, delete, or modify any provision of this Policy at any time without notice.

Refusal Of Service

We reserve the right to refuse, cancel, or suspend service at our sole discretion.
